Terms of service

These terms govern your use of Caspira Live, operated by Caspira Solutions LLC. By creating a workspace you agree to them. If you are agreeing on behalf of a company, you confirm you have the authority to do so.

Accounts

• You are responsible for the accuracy of the details on your account
• You are responsible for activity carried out under your users' credentials
• Each person using the workspace should have their own user account rather than sharing one
• You must tell us promptly if you believe an account has been compromised

Acceptable use

You agree not to use Caspira Live to:

• Send unlawful, deceptive, harassing, or infringing content
• Send unsolicited bulk messages to people who have not agreed to hear from you
• Collect personal data from your own visitors without a lawful basis and proper notice
• Circumvent plan limits, rate limits, or access controls
• Attempt to gain unauthorised access to the service or another workspace
• Resell or white-label the service without a written agreement with us

We may suspend a workspace that puts the service or other customers at risk. Where it is practical to do so, we will contact you before suspending rather than after.

Automated replies

Caspira Live can generate replies automatically from the knowledge base you provide. You remain responsible for what is sent to your customers under your brand, including automated messages. Review your system prompt and knowledge base before enabling automatic replies, and keep in mind that a language model can produce an incorrect answer. Tools to limit this — reply delay, ticket escalation, and immediate human handoff — are described on the AI customer service page.

Your data

You retain ownership of the conversation and customer data in your workspace. We process it to provide the service, as described in the privacy policy. You can export your conversation data, and you can ask us to delete your workspace.

You are responsible for having a lawful basis to collect the data your visitors send you, and for telling them how you will use it.

Plans and billing

• The Free plan is provided at no cost, subject to its seat and conversation limits. See pricing for current plans and limits.
• Paid plans are billed in advance for the period you select, in US dollars
• Fees already paid are non-refundable except where required by law
• We will give notice before a price change takes effect for an existing paid subscription
• You may cancel at any time; the plan runs until the end of the paid period

Availability and support

We work to keep Caspira Live available and will give notice of planned maintenance where we can. We do not currently offer a contractual uptime guarantee on standard plans. Enterprise arrangements are agreed separately in writing. The service is provided as is, without warranties beyond those that cannot be excluded under applicable law.

Roadmap items

Features described as on the roadmap are not part of what you are buying. Only the capabilities available in the product at the time of purchase form part of this agreement.

Liability

To the extent permitted by law, neither party is liable for indirect or consequential loss, and our total liability for any claim arising from these terms is limited to the fees you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited.

Termination

You may stop using the service and close your workspace at any time. We may terminate for a material breach of these terms that is not resolved after we have raised it with you. On termination you should export any data you want to keep.

Changes to these terms

We may update these terms as the product changes. We will revise the date at the top and, for material changes, notify account owners directly. Continuing to use the service after a change takes effect means you accept the updated terms.
